What the hack is "finned"?
You'll be fine, there is nothing to worry about. It is like installing cia; nintendo is not checking if you bought the game or not.

don't fool yourself. You can use it of course but downloading software which you don't own is illegal in Germany. Even foreigners visiting Germany on holiday can be fined. There are special lawyer firms in Germany making money by chasing illegal downloaders and uploaders. By using freeshop your ip-address is known to Nintendo, up to them to do something with it or not. Probably not but that could change in the future.

Most countries in the world (except for a few countries that don't hardly have any human rights) have some Copyright Act bill amended. In most countries, a violation to that bill results in a fine, but some countries (such as mainland China) result in criminal charges, but most big businesses will only go chasing after the people who are very well known and keep exposing themselves to the public. To avoid getting caught, the best course of action you should take, is to NEVER ever ever sign up with your billing details on places such as Apple's App Store, Sony website, or some other company that holds huge stakes in music, movies or other stuff. If anyone is popular, just try to remain anonymous about your location details when signing up on websites. And if you're not popular, don't worry about it and just don't sign up to Apple or any website requesting for billing details, just incase you may become popular in the future.

Also, freeShop remains anonymous too, the only thing Nintendo will see on their server, is just your IP address, they won't know anything you're doing. Nintendo will only see both your IP address and the ID of your friendcodeseed.bin and the game you're currently playing, only when you're playing a game. But even if you are playing a non-purchased eShop game in an online multiplayer match, all that Nintendo can do, is ban the ID of your friendcodeseed.bin, but that's highly unlikely with downloaded titles because Nintendo hardly would ever check anyone's Nintendo eShop account purchase history with the downloaded title you're playing. The only time Nintendo banned people for playing online with downloaded versions, was when people were playing Pokémon Sun/Moon early (which even happened to people who purchased the game early from a retail store, in game card format).

And it's perfectly okay to use freeShop, it should work in Germany, you need to obtain the encTitleKeys.bin from some website and put it into the freeShop folder. Once that is done, then all the titles will appear on the freeShop of any region. You can download any of them, and don't worry about the games you've downloaded on freeShop, no one will know. ^^
