The cfw/gateway you use doesn't matter, this limit is universal.
A full system transfer is impossible, your only option is to contact Nintendo to transfer just your nnid.

N3ds 9.9 -> n3ds 9.9 (hard mod) -> downgrad to 9.2 and xor 9.9 and log into shop to capture nnid

I think this would work, I also think I could downgrade 9.9 with a trick I know but it will require a hard mod
