Hey i load my saves befor my switch get bannd to my Cloud. Now i have a new switch can i log in with my old account and download that save with out getting band?

I did this very thing a couple weeks ago. My old Switch got banned but I had already had my saves uploaded to the Nintendo Cloud save. I purchased a new model Switch that has the better battery life and screen then after setting up my account I was able to pull all my cloud saves back to the new Switch without issue.
I seriously doubt the new Switch could get banned since it isn't even possible to mod it anyway.
