Are cartridge games coded in a way so that Nintendo can tell if you're using a ROM on a flash card and not a real cartridge? From What I understand, roms, unless they added some lines like in the past where you found out that Nintendo used downloaded ROMs for their virtual console, shouldn't be unique but always the same data. So if you dump your own games, then sell them, you shouldn't have issues, unless Nintendo detects the flash cart itself, right?
If not this makes little sense and modding your switch is a much better idea, especially thanks to overclocking which gives insane performance advantages to the stock Switch with an OLED Unit.

Nintendo already did this with the 3DS, but forgot to check whether the serial number matched the game you were playing. That doesn't answer my question, also it's not pirating, I'd use a copy of my own game, which I'd happen to sell some time later and perhaps someone would use it online later and get banned themselves. It's hard to imagine they have serial numbers hidden on every cartridge data but I guess it's not impossible and there have been people getting banned for using pirated (not self dumped) roms in the past.Just don’t play pirated or downloaded games and you’ll be fine
Crazy, thanks for the information, well I guess it wouldn't trigger in my case but if you use pirated ROMs you got from some site that are mass distributed they for sure are getting flagged. Begs the question though, why Nintendo wouldn't bake in that data into their firmware updates for "stability" reasons, so those pirated rom copies cause an immediate ban, even when you're offline/have the Nintendo IPs blocked. It's more of a theoretical question, trying to understand how they do things. I'd use the mig switch for convenience reasons mainly, not having to take 10+ switch games with me on the go, which I could also lose. Hope they don't get any bad ideas for the Switch 2 then, that would kill the used game market.
