That's likely what they caught first. If you had gotten away with that, then in time, you'd likely have gotten banned for hacked material.

I wonder if I'd have a nickname like "El Gringo" would get me banned even though it's not a derogatory term. Or "El Faggy". Before anyone gets upset, "fag" is how folks in UK call cigarettes.

That may be but faggy, whether it be an adjective or something else, is not really a term for anything cigarette related. There are 2 reasons the Miiverse admins are bad.
1. People think they're bad because they don't understand the rules and think they were "false reported"
2. People overwork the admins with memes and innuendos and other inappropriate uses of Miiverse that the admins assume everyone is guilty. There are quite a few times I've had warnings for sexual content when i wasn't referencing anything sexual, just because I used words and phrases that other people used inappropriately.
