It requires the latest firmware, so until Gateway fixes 9.6.0 for N3DS consoles, which could be a while yet, we're out of luck.

It works on 9.5 fine for the daily free plays, you just can't buy any. (At least on an ordinary 3DS without gateway)

The update is indeed available if you know where to look. I think cearp's clean CIA dump got deleted though. Hope the RF one I found somewhere doesn't freeze up (I'm not sure why they did that, it's not like there's themes on 4.5).

The update works I'm on 9.5 emunand on a new 3ds. Won't work if you have the update nag though like my 2ds it won't let me ender nnid
