I mean they literally tell you where to download switch games and what to use to play them.

Nintendo wanting piracy on their devices is just... it's not even wrong. It's outside of the realm of being right and wrong. It's something that doesn't make a lick of sense.

Nintendo is and always has been a publisher for it's own console, they get a cut of the sales made on it. They release their first party and second party games, which pretty much always are their exclusives (Pokemon counts as second party), which makes them the reason people tend to buy a Switch. Suggesting they want piracy is entirely hypocritical and goes against the way they treat anyone who dares so much as look at the idea of emulating (not pirating, emulating, Nintendo hates emulation) a goddamn game from the 80s (aka the NES), in spite of the fact that those games might not even be accessible legitimately in a way that earns Nintendo money anymore.

In addition, hardware sales don't earn them money, not a lot anyway. Nintendo consoles get sold for about 300 bucks in euros and dollars. This probably is a very small profit margin, which makes sense considering Nintendo sells the Switch without any bundled games, which means that their profit from the system has to come from selling titles.

What exactly is going through your guys heads here. There's a dedicated pager on Nintendo's site where they go on about the piracy problem. Who is looking at this page that is not already familiar with piracy? How does one get to that site with out having knowledge of it beforehand? To the point where you think someone who has been oblivious to piracy but just might try it out after reading where to go from Nintendo's anti piracy site?

I would assume you'd be able to read context.

They mention the sites because they're blocked in Italy. I should not have to explain this, the posted image literally clarifies it. Simply saying "Nintendo blocked some sites" will not be clarifying to how they're putting in effort to block piracy.

They list these products and sites (and if you look closely, the majority of listed products are flashcards and products of a similar nature, which TX's product falls under, there is nary a mention of CFW on there, even though every CFW since PastaCFW on the 3DS permitted piracy) to inform vendors of products that they can't legally sell (at least over here, flashcards and products of a similar nature aren't allowed to be sold due to a 2011 ruling) and to show their shareholders they take action against piracy.

This is a thought process that should be goddamn clear if you actually read the thing or even bothered to look at Nintendo's anti-piracy page instead of trying to make outrageous claims that hold no water if you even bothered to read the thing instead of focusing on a single bullet point. Doing what you just did makes you look like a fool.

You also seem to have missed my entire second explanation, where I note that this page is intended for vendors and shareholders so that they can both see that Nintendo upholds their effort to combat piracy, and to inform vendors of what products they cannot sell.

Nintendo does want piracy gone, they're by far the most aggressive anti-piracy game publisher out there to combat it. Suggesting they secretly prefer to keep it goes against the entire history they have had in the past 4 years of taking down ROM hosting sites, their recent lawsuit, their anti-piracy page and so on and so forth.

Where it is discussed is on Nintendo's site, not here on GBATemp. What happened is that @zoogie noted that Team Xecuters product (which on it's initial release was a piracy enabling device and don't bullshit me with that it isn't it's primary purpose) was added to Nintendo's anti-piracy site. Then you and some other members seem to have latched onto the fact that Nintendo are hypocrites for directly naming a piracy site, whereas context indicates that their site is a. not meant for consumers (vendors and shareholders) and b. there is a perfectly valid reason for them to name it (again, "some piracy sites" won't appease shareholders, they want more detailed context), which makes your argument complete and utter bollocks.

I'm not even gonna dignify that last part with a response.

it's not copyrighted, so it's fair game to discuss it. After all, R4 and other flashcards have been listed as piracy devices by nintendo and courts have ruled that shops are not allowed to sell them, yet GBATemp still has a section dedicated to DS Flash Cards.

Sure, but the OS for those products specifically has not been named as piracy. While it seems like a minor distincton, SX OS can be run seperately from the dongle, which could change it to fit the definition of Warez, and specifically the "We do not condone piracy in any way." part of the anti-warez rules, since SX OS is now specifically called a piracy program by Nintendo.

This probably deserves its own thread but I just found this on nintendo's ap site.
Looks like they're about to go on a major offensive against TX SXOS retailers.
They also confirm their banning activity.
Unfortunately, nothing major will come of this. The only thing we'll possibly see is the closing of a few re-sellers that happen to be in territories where their rights come second to multi-billion dollar corporations. Until a raid of TX's headquarters is announced, for whatever reason, they're safe.

Good thing cheap dongle clones and better, free-software alternatives exist! Impossible to crack down on that sort of thing, beyond Switch hardware and software revisions.

You can't be serious.

Their AP site is not only difficult to find, its not directly linked on any of their general front-facing webpages. You have to almost be directly looking for the page in order to find it, at which point its not directing you at anything you wouldn't already be aware of.

The logic some of you twist yourselves into trying to justify your own shitty behavior is honestly baffling.

This is standard practice so that they can layout legal guidelines. Now, for instance, they could come to a site like this and say "advertising of or allowing a platform for" product XYZ is considered endorsement of and propagation for piracy. Which a site like this probably would not want to deal with. It also outlines a loose threat to any one selling the product who could be in Nintendo's crosshairs. Since a lot of resellers ARE in easily actionable areas, this is a threat of legal action.

Nintendo has taken (and routinely won against) resellers to court in NA and EU.

Still, I'd argue the OS itself is not piracy. It doesn't allow direct access to pirated content, it merely allows you to use pirated content you downloaded elsewhere.

Done with Nintendo time to sale it before you get refurbish system.
