Homebrew [SWITCH] When dumping my own physical game and then launching it as "a cartridge" (Although no game is inserted) can Nintendo still tell its a dumped

I've noticed that on Team Xcuters cfw you can launch games from the gallery album. The game then appears as a cartridge. If I dumped my own cartridge (meaning that my cartridge specific code is still unique to me) that they cannot tell?
I get that there is still a risk in doing just about anything. They might notice something else but I am just curious as to the card. Can they tell that you are not really launching it though a card? The system seems to believe that you have a card inserted and as long as not anyone else is using the card (Which Ninty would notice as it is not possible for the same card to be online on more than one system) it should be quite safe to do so right?

Using things like homebrew or CFW on your console is always tied to the risk of getting banned. We don't know yet what Nintendo is able to detect and therefore I would recommend you to keep your console offline if you use any sort of unauthorized modification. Today many people have been banned for using SX OS and playing backups. That's why I would be even more careful now.
