Maybe if it were possible to run unsigned code from a homebrewed 3DS (with smash3ds to smashwiiu, via file transfers for customs)

Nintendo may have learned from their past mistakes, however, they are by no means infallible, and as such, there are bound to be more vulnerabilities. SSB4 may have some, but it might not be for a long time before they're found.
