“Defendant not only offers the hardware and firmware to create and play pirated games, but he also provides his customers with copies of pirated Nintendo games,” the platform holder’s complaint says.

Hope to god this isn't true, cause if it is:
1. Seller is a dumbass and is guaranteed a loss
2. Will deter anyone from offering the service of installing a modchip in the future if they see "Modchip installer got taken down by Nintendo" (since its obvious they'll exclude that tidbit in most titles)

If it ain't true though, then hopefully the seller manages to win this court case.

If Nintendo is claiming that, that subject (was going to call it otherwise but with the risk of being banned) included pirated games/content, its because they have how to prove it, that's for sure.

I got a modchip installed by his "company" and there were no pirated games included, but all the software was set up with a bunch of homebrew like Retroarch, Tinfoil and all that. Atmosphere and Hekate/Nyx with sigpatches already applied, but this was after Nintendo sent their first cease and desist letter (that was unknown by his customers at the time).

He's not hiring a lawyer because he knows he's going to lose. Why bother spending probably tens of thousands of dollars when he's just going to accept the judgement and file bankruptcy anyway?

well the simplest thing to do is bring a modded switch to court, no SD card, press power and say "ladies and gentlemen, i rest my case"

if this guy was selling pirated games thats a different story. i would bring a normal OFW switch with a bunch of games on it and a modded switch with the same games, put it in airplane mode and tell them to discern which one is illegitimate.

im too lazy but i thought of a great idea to fuck with nintendo - make a series called "is it emulation or real hardware??" and run a game (either emu or real hardware), overlay the gameplay on the switch and make nintendo try to figure it out :rofl2:

selling a kitchen knife is legal because its what the user intends to do with it that matters. just because someone can cause harm with the knife doesn't mean the knife itself should be grounds for litigation.

aren't you forgetting nintendo make up the rules and laws to however they choose benefits them and not the rest of the worlds real laws

They make these ridiculous claims because they know that lawmakers, lawyers, judges, etc. are unlikely to know any better about this sort of thing. That's how we end up with laws like the DMCA that shouldn't even exist at all.
