I was away from the scene for a while, is it still safe to buy a new switch for hacking or is it patched. My intention is to buy SX Pro Mods Kit and backup etc... Will that work find? I just need to know so I dont waste $350 plus...
There are new switches in the wild, but it depends on the store you're buying it from. Also you can return the switch (in time) and get your money back. At least that's how it works here (Czech Republic).

Btw this will be my second switch my first one was stuck in a boot loop so I tried charging it with my tablet charger... and it was bricked a month after warrant.. nice.

If you already have a Switch, why not just buy a used Switch Tablet on eBay? If you buy just the tablet it generally goes for around $180. It'll also be basically guaranteed to be a hackable model.
I just ordered a second one from Amazon UK which arrives tuesday. I'm hoping it will be old stock running 4.1.0 so I can keep that one for homebrew and update my current 4.1.0 one.
If not the new one will be the legit online one and I'll have to somehow try and unlink my account without updating.

I don't think you can unlink your Nintendo account without updating. Not from the research I've done anyway.... I would love to be wrong because I want to unlink mine on my 4.1 and leave my 2.1 second switch in the box for now. I don't care at all for online...
apparently you can call nintendo an they can do it for you, that said, hoenstly if you are gonna do it, do it NOW, switches are still relatively abundant so i dont know for sure that stock wiill be new units, that said, if you dont mind light use, ebay is a good option.

Didn't need to in the end, the new switch was on 4.0.1 and is not a patched model. Looks like I can update the first switch and keep save games and linked account
