Hacking (Random question) is it legal to sell dev units to other devs

so anyways, I have been looking into making 3ds games for awhile, but the price of a dev unit has always kinda been too high for me, and I don't have a ton of money being in school. But I have a dev friend with a dev unit, and I'm interested in buying it from him, and he is offering a very low price. I am not currently in the dev program, but can register. Is it legal for him to sell his dev unit to me and am I allowed to develop games with it that go on the eshop?

Yes it is, there is a equipment transfer form on the dev portal. Both must be under agreement for the 3DS platform.
