ROM Hack Question about transfering modified saves from hacked to clean Switch

So I recently got a new patched Switch to play online with but I was wondering whether transfering modified data from the hacked Switch to this one would result in a ban. All I'm trying to do really is unlock everything in Mario Kart 8 and Crash Team Racing from the start and nothing else. I've seen some people say it'll result in a ban while others say they've been doing it just fine and even with hacked Pokemon saves. I just need a clear answer and any precautions I should take.

It can lead to ban. Just most people still didn't get ban for it, but that doesn't mean Nintendo didn't flag them.
Any save modifications in games with online features is like welcoming ban.
