I'm sure they're not checking for newest NVer and CVer (have installed custom NVer and CVer so the System says "1.0.0-99X").
probably they're checking the version of NATIVE_FIRM.

They changed how the server-side works for the 3DS. It's like the Wii U now, you need the latest firmware to do pretty much anything (or install system CIAs that are updated to the point that it stops bugging you, but it's pointless and risky to do so, since it creates a franken-firmware). You're pretty much going to have to downgrade to 9.2 and run an emuNAND or upgrade sysNAND to 10.5 (creating a franken-firmware of bits of 10.5 and 10.3 is a bad, bad idea).

I have so many digital games on my 3DS, doing an emuNAND means my official NNID could be jeopardised and losing my games. :/

So am I understanding correctly that the 3DS now forces updating in the same way the Wii U does if left alone?

As long as you have the homebrew DNS setup your fine right? But then what about access to eShop and other online functionality.

Not quite. It just pops up a box saying you must update if you want to access online services. No forced update. I don't think that's realistic to do for a handheld that could be low on battery.

A few users in this topic said forced updating which is why I wanted to get solid confirmation on that.

I'm running emunand 9.2 on n3ds, so what's the best workaround for this? Do I update emunand to 10.5?

Just update emuNAND to 10.5 if you're not on RxTools. If you're on RxTools, either A) switch to Cakes/Reinand for now or B) look around for that thread which tells you which CIAs you need to download and install to "spoof".

EmuNAND is confirmed to work on 10.5, however depending on what model system your using you may need to change CFW.

Their definition of "forced" is pretty strange. I assume they never owned a Wii U to understand what it truly means.

Did the spoof, checked settings so got it to Rei 10.5.0-30E though still getting the same error when trying to go online.

EDIT: Scratch that, re-started and worked fine.

I just did actually, and went to update emunand inside reinand (I confirmed it was in reinand mode)
Now, when I try to boot emunand, I get stuck with "preparing your home screen" and then a black screen. From your tutorial thread you mentioned that it was likely an issue with menuhax, but I don't seem to have a "theme" folder inside my emunand directory. Any other thoughts?

edit: I do have an emunand backup so I'll restore it if I can't figure it out
I had this problem. Just hold left shoulder button as ReiNAND boots and it fixed it for me. Now works without any problem

Next logical step for them would be setting up a security system (think XOSC for Xbox 360) to keep CFW users from going online at all.

So I get it what happened to me today.
I tried to go online with smash today on 10.4 Rxtools emunand
But i got 022-2384 (Something like that, Im not sure bout 2384)
error code and i thought i needed to update my smash.
But no. I updated my emunand to 10.5 and I get error on eshop...
Smash works now.
Someone?

My brother just told me he can't play online battles in pokemon omega ruby because the game asked him to update to the latest firmware... i thought it was due to some sort of server maintenance, but this thread confirms it.
The server maintence happened yesterday for Pokemon X but today it forces me to update to the latest firmwatre. Eshop still works with latest tiger and nver (spoof) but how to spoof the latest firmware so that the game things we are on the latest without updating to the latest emunand?
