The difference is that games are now blocked if you don't have the latest firmware. Before, it was only required to have the latest game update. Now everything needs the latest game update AND the latest system firmware in order to do anything related to Nintendo's online services.

There's 1 thing I don't understand, a friend of mine is on 9.2 emunand and he's still able to play online without updating and he hasn't done the nver spoofing yet.

Are you sure his actual emuNAND version is 9.2? He's probably just on 10.5.

When I first read about this issue I could still connect but trying again recently I can't, maybe its slowly rolling out?

I don't really feel like Nintendo has done it to stop Homebrew and such, I'm sure its a + to them but once the new Nintendo Global Login thing starts rolling out they are going to want as many people in on that eco-system as possible and having to be on the latest firmware seems like a solid way to make sure people are.

Lets face it, its surprising online has still worked on older firmware, no current home console lets you online without the latest update, not sure how it goes with the VITA I feel like it would always tell you to update.

If I'm not mistaken, the Vita needs the latest update as well, to play online/go on the shop. It's only the Nintendo 3DS out of all the current-gen consoles that was "lacking" in this area.

On the Vita, it's actually anything that has to do with PSN sign-ins. You can't even do an internet connection test on an older firmware because it signs in to PSN lol.

Then there's the PS3 which doesn't even let you update the date and time over the Internet without being on the latest firmware..

On my N3ds, stock firmware 10.3, I couldn't connect online with Pokemon Omega Ruby.

Not sure if it's server maintenance.

They changed how the server-side works for the 3DS. It's like the Wii U now, you need the latest firmware to do pretty much anything (or install system CIAs that are updated to the point that it stops bugging you, but it's pointless and risky to do so, since it creates a franken-firmware). You're pretty much going to have to downgrade to 9.2 and run an emuNAND or upgrade sysNAND to 10.5 (creating a franken-firmware of bits of 10.5 and 10.3 is a bad, bad idea).
