Nintendo doesn't dedicate anywhere NEAR as much to homebrew patching as Sony does, and neither as quick either.
Ninty: Waits months, realizes it's a thing, passively puts out update loooong time after.
Sony: Finds out exploit, closes down PSN, removes games from store (And even from downloaded lists, which is illegal btw), forces update a day later, no workaround, screws up core system functions just to limit homebrew.
Ehhh... I think they are just more worried about the consequences of letting it go further without moderation. Smea tries, but as with the PSP scene showed, it can turn 180 at a moment's notice when a given pirate is has the chance.
That, and the fact Retroarch BASICALLY kills off the reason for legitimately buying Virtual Console titles soooooooo...
