Yeah, it definitely wasn't there prior to 4.1.0 for some reaason.

I don't think that will do anything. We know that people disabled error reporting and still got banned.

The info Nintendo uses to ban are not normal analytics.

Sharing error information actually starts off disabled by default AFAIK, so that definitely hasn't helped anybody.
Whether or not disabling usage information sharing on your Nintendo Account will make any difference is anyone's guess, but who knows?
