No. Mariko isn't that far off. It didn't show up in firmwares for the lulz.

what you dont know, is, that nintendo will track this based on your NN id, so even if you do return it to the down unda, the second you relink it, the ban hammer will drop.

Are we certain the bans are linked to Nintendo ID? If so you still get a new switch and just have to create a new ID I guess.
