I believe gspwn is what's "broken" inside the 3DS firmware.
If gspwn were to be patched - which is apparently no easy task - homebrew in itself would stop working, no matter the entrypoint.

How long do you think it'll take to patch something like that?

I'm no expert, but I imagine they're never going to bother patching it. It's easier to just patch entrypoints as they appear, sometimes the "fix" is as trivial as forcing an update (such as browserhax or tubehax) or adding an extra security check (like Menuhax)
