Pokemon Company continues to pursue Sword/Shield guidebook leakers, court allows for subpoena

The investigation as to who managed to leak the Pokemon Sword and Shield guidebook continues. As reported upon last month, The Pokemon Company International took the initial steps to begin a lawsuit against a group of users who managed to leak images pertaining to Pokemon Sword and Shield, weeks prior to release. These images originated from an official guidebook, with the contents so closely guarded, that it released a week after the aforementioned games. When the images were shared online and went viral, The Pokemon Company and its representing law firm claimed that it caused "irreparable injury" to the company and brand. Previously, they were seeking a subpoena against both Discord and 4Chan, where the leaks supposedly originated. The motion has now been granted, and both sites/services will now be required to give any information that could lead to the identification of the three leakers.

Before the Court is Plaintiff The Pokémon Company International, Inc.’s (“TPCi”) Ex Parte Motion for Expedited Discovery. Having considered TPCi’s Motion and all other pleadings and papers on file in this matter, this Court hereby GRANTS the Motion. TPCi may serve subpoenas on Discord, 4chan, and DimensioNz#3307 before the Parties’ Federal Rule of Civil Procedure 26(f) conference.

before people get all pissy over this. These people deserve this 10000000%. Don't want to risk getting in trouble? don't leak stuff. And for all of you who will have some smart comment to say.. just think if this was your work that you put a lot of time into only to have some idiot leaked your stuff that had a strict release date. I bet you would sue aas well.

As important as it is to protect an IP, I do wish they would have used that energy to have finished polishing their game. Sword and Sheild are fun but they have a lot of flaws.

They can "leak" anything if they already got the game delivered to them. Nintendo sent out the games... Its not like someone stole the cartridges and spread them on the internet.
In such a scenario it isn't even a "leak" since... again... Nintendo sent out the games. Which means the games had a release date BEFORE 14.11 BECAUSE Nintendo sent them out earlier.

You as a normal consumer DO NOT need to know the "official releasedate". You DO NOT need to be a expert. If you purchase the game and the game gets delivered to you, you CAN share game info with other people on the internet. No matter when the so called "release date" is.

Nintendo loses the right of keeping game information secret at the moment where they ship the games out to you/to stores that are selling them earlier.

No amount of leakage will hurt the sales if your game was actually good :teach:

They should've just used all that lawyer hiring money to actually put out a decent game lol

At the same time this is kind of expected these days, how was this leaked, from stores?

This should be a reminder to any stupid individuals to cover your tracks and not have your self connected with your true identity. Pokemon Company is a hudge conglomerate prepare for some serious action. :whip:

If you get caught it’s your own fault, it isn’t that hard to leak something without them finding you. 99% of the time they get caught because they want fame/attention

As it was already said, Nintendo has to expect the game to be considered as released the very moment they send the games. Arbitrarly deciding of a release date and then trying to sue those whose stores sold the game early is idiotic at best and insane at worst.

Oh, and in addition, it gives me a lot of bad faith vibes from Nintendo. I was a fervent buyer of new Nintendo (and especially Pokémon) games, but no more since they went with that decision, as that is the only way to show them how I don't support these policies.

Nintendo was always like this. They are on a fantasy world power trip.
Shipping games out before their own "release date" and still suing afterwards.

Why not ship all the games out on 14.11.2019 to all shops/consumers instead? I know it is a lot but this works out perfectly fine.

it's their own dang fault for trying to hide how crappy the game was.
like, they even avoided showing more pokemon prior to release like they usually do because they knew how bad the designs ended up thanks to the foreign art director.

everyone is going to blame this on nintendo, while gamefreak will get a get out of jail free card for posing as a poor indie company.
like, pokemon is literally the highest grossing franchise of all time, on all media!! it's bigger than star wars, bigger than disney. yet they just use the games as a vehicle to advertise the new toy line nowadays.
have you guys seen the insane amount of money they spend on advertising for the games vs what they actually spend on the games??
it's crazy

nowadays we're not even getting cool spin offs like the series had on the ds, gf themselves is pooping a main series game dumbed down for pokemon go players every year

I might agree with you about the fact that Id want to sue if my work was stolen if not for 3 things.

1) They aren't talking about the game being leaked here. They leaked some images. They are basically being sued for spoilers. That seems a bit much to me.

2) You are talking about a company with enough money to literally buy New York. They'll be fine...

3) Sword and Shield is a dumpster fire of a game anyway, and this is likely a sad attempt to push the blame on someone else. "Oh, they leaked images of stuff early and it made us look bad and ruined the game." ...No Masuda, your team just did a sub-par, minimal effort job and it shows.

maybe this is how things work in DE, but not in freedom land where lawsuit wins who has more lawyersbulldogs.
