Because updates are signed; and if you can (as in "have the ability to") change the version number and sign it again, you might as well preinstall Vitashell as system app in that update

You can patch checks in the OS that would prevent you from installing the modified update, but you can't (to the best of current knowledge) cheat around the anti-downgrade system the Vita uses (which doesn't appear to be that well documented either!)
