Nintendo would like to reassure any concerned consumers that under our European terms and conditions and in compliance with European requirements Nintendo does not have rights to user content, such as comments, messages, images, photos or movies, which are shared in private communications between users or simply stored on Nintendo 3DS.

Well, if Nintendo can't do it in one place, they probably will learn their lesson and not do it anywhere else.

It's not like Nintendo can brick our devices anyway.

Of course, this doesn't deny that European users can still be bricked. Also, the Terms are only part of the story here. There is still the DRM software, used to enforce the Terms and keep users under Nintendo's control so they can't modify or improve their own systems.

And they are still... 0 3DS bricked because of piracy.
So defectivebydesign.org are mad about something that didn't happen and won't happen, hmm...

DBD are MAD about privacy, not anti-piracy measures.

lol Indeed. When Nintendo said it themselves, I just knew it couldn't be true. However, I'm not sure for US. Even though, every member of GBAtemp says NOA is not gonna do it. I can't help but wonder...

This whole bricking paranoia is silly. Nintendo is capable of bricking the 3DS via update. Well, Sony can do the same with their PS3, MS with their X360, and any company that makes updates to their hardware. There's no question that they can. They won't because they know it isn't in their best interests, and with how long Nintendo has been in this business, to think they could get away with it is suicide for them and they know it.

Now, should their update, which is meant for an unmodified unit, brick your modified 3DS, then it isn't their problem. You can do whatever you want with your purchased device, but that doesn't mean the company making the update has to make some promise that nothing will go wrong with something not under their control.

Where did all this bricking talk originate anyway?
I thought it was just some memo released to a game shop saying not to take trade-ins of 3DS' used for piracy - something Nintendo has no hand in.
