Its petty crap like this that destroys creativity in the game industry. Why would any small start up take a risk if the likely hood meant being taken to court on a whim.

As a kid I loved the gaming industry back in the 90s. Now I mostly despise console and publishing companies.

Thank goodness for communities like this and the emulation, homebrew scene.

Yeah, it's such a shit show. Patents ultimately destroy video games as a whole because they steal the idea/s from the original creator/s, then file it as their own work when it isn't. From there, they could use the patents in court against you illegally.

Nintendo has a massive monopoly over all other major video game companies, which contributes to their strong sales.

Go over the patent applications of any major tech company and you'll find thousands upon thousands of patents covering pretty much everything in existence.
This is called "defensive patent aggregation" and it's used to preempt patent trolling. All large companies do it and they usually don't sue over those patents (except as a countersuit against a patent troll).
If FAST, wherever he may be, were here he'd have a few dozen examples right now.

Being a copy-cat has nothing to do with being creative.

After Nintendo's WiiMote was a success, Sunny and M$ copied the idea and brought devices that tried to provide the same experience to their customers (none of them succeeded).

After the Switch became the best selling console of its gen, many electronic producers have been trying to copy it. And I'm not saying that the idea of such device was new nor to some extent "original", but Nintendo knew how to make profit out of it, and so far they haven't infringed any patent to the point law enforcers made them pay for such violation. Any litigation has been overruled.

Many first party games of the Switch have a copy-cat on other platforms, but they can't provide "the magic" Nintendo customers receive.

Patents exist for a reason and even if I hate/love it, they must be respected and enforced by law.

Ooooh, I got a flashback from this: Domain Squatting!

In the 2000's, people could go on GoDaddy and get domains registered. Some people thought they'd hit a payday by anticipating big product releases and registering the domains. I forget how that worked out, I think IP holders just threatened legal action, so no one got the fabled jackpot payout.

Was there ever an instance of this working?


As a bonus flashback, this spawned the "Coffee Shop Skype Meeting" parable: Once upon a time, some hotshot started a Skype meeting with his business partner in the middle of a coffee shop. They were on a roll brainstorming product names. After a time, a customer waltzed up and declared that he had registered the domains of all the proposed product names.

The sad thing is, the 2000's were a time of out-trending everyone, so I can believe someone tried to hold a confidential business meeting over Starbucks wifi.

OP just got sued 3 times.

Nintendo owns the word patent, and stupid, and they own the word own.

Sadly it's going in that direction with these patent trolls. The gaming business amongst others are due massive correction as consumers or developers switch off.

It's already happening with collapse of post COVID investments....

I assume that companies patent the fuck out of everything to protect their ideas but in most cases let cases of patent infringement go because they don't want to incentivize lawmakers to restrict patent laws. Palworld must have really fucking pissed Nintendo and GameFreak off.

Good shout! Not sure if this ever worked, I think I've heard a couple of 'success stories' in the past but these stank of urban legends, which they almost certainly were.

Boy, I'm proud of being the dad of my young lad, Mario Rossi da Silva!

Just posted a video of his 18 y/o birthday party on social media, he's finally growing up to be a fine young man!

Wait! Oh man, I just got sued by Nintendo! Apparently the word Mario is now their official property, and I since I had no way of knowing I had to contact their lawyers first, way back when my child was born, I now own them 10 million dollars!

Guess it's jail time for me! But don't worry fellas, we'll overcome this minor setback together! 💪
