Ever see a Pokemon tribute video, a Zelda fan film, or a Super Mario Bros. gaming mod and wonder how the people who made it got away with it? Don't Nintendo's lawyers know how to use the phone?

This is how a Nintendo shareholder asked the question in late June:

Got that Nintendo fans? Seems like you can get away with being playful about Nintendo's characters. Just don't diminish the dignity of that intellectual property.

I was about to say that, but then I remembered all the Mario/Wario slash yaoi Pokemon hentai I've collected seen and... no. [IMG] Whoever said there's no such thing as bad publicity has obviously never heard of Rule 34. And the pics I've seen featuring Kirby, Yoshi and four Gyarados? Unspeakable. But obviously not -undrawable-. Pocket Monster indeed.

But trying to sue people for their idle doodles and fanfics is like trying to move the sea three feet to the left using a spoon. It's mostly harmless fun, and going after kids for dressing up as Mario for Halloween and similar transgressions would be shooting themselves in the foot and make them look petty.

Many people love Pokemon hentai (not me, really). Surely it's advertising to them?

Anyway, that's good to know. I always wanted to try and make a Zelda fan movie to the best of my extent...Which isn't very good. [IMG]

Why would a company want to go against people who love them lol? It wouldn't make much sense.

i thought the ones who demands the money are the record companies the musicians work for?

They only demand money if the the person who covered the song is making any money.

I don't think so. The homebrew projects can still lead towards the path of piracy which is a no-no for Nintendo.

Ask Square Enix, they have a history of getting rather... aggressive towards people who make Chrono Trigger fangames.

But seriously, I understand Nintendo's position on the situation - why prosecute the people who make you money in the first place? Makes poor business sense.
