Nope. They can't legally. Though they have all the legal right in the world to ban you from online.

Wait for a real 3DS flash cart, then you can bring this up. I doubt Nintendo will risk being sued just because some people are playing *gasp* DS games on their 3DS.

the same ToS are found on the wii.... it doesnt mean nintendo can brick your system and your an idiot if you believe that, all its saying is YOU can brick YOUR OWN system by using illegal things like flashcarts or software hacks. I dont understand what the problem is with them tracking your user data... it just shows what games you played... there is no real name telephone numbers or addresses on the 3ds.

Patience, my friend. It says that Nintendo has confirmed that they can brick your 3DS but were not entirely sure that they will since it is illegal. So the best way is to wait for the system update on June 6-7 and all questions about this bricking can be answered. and btw, every console in this planet has been hacked.

Sorry for more one 3DS brick post, but I thought that this one was different from the others because of the websites given more confidence for this subject.

I really don't want to Nintendo brick any system :/ Freedom for the fanboys! :-)
