I haven't used my New 2DS XL in quite awhile because I was using the MicroSD card for one of my Nintendo Switches. I put all the backed up files from my PC back on my SD card and my 2DS still had a little charge left and the red light was blinking. I charged it all night and I took it off the charger and the light was still blinking red. I was playing Smash Bros for over an hour and my 2DS hasn't died yet. Also my 2DS has Luma3DS CFW installed

UPDATE: So I left it on the charger powered off for about 3 days, I turned it on and it was fully charged with the blue light. So it fixed it's self.

If you intend to play the n2DSXL for any long duration and without an attached charger, yes you'll have to replace your dead-ish battery.

Just out of curiosity, since you have cfw, what does the 3dsident homebrew tool say on the battery page?

3dsident says this on the battery page:

    Battery percentage: 1%
    Battery status: charging
    Battery voltage: 209 (4.1 V)
    Adapter state: connected
    MCU firmware: 3.65
    Power-saving mode: disabled

Other than battery percentage, all looks pretty much the same as my n3dsxl (bought in May). Voltage is slightly different, 208 instead of 209, doubt that's very signif.
