Yes, If the N3DS hasn't been used, the firmware versions tied to the serials will be accurate. There are a few serials on the list that were likely from N3DSes that were updated before the buyer received them, none of those serials have been confirmed though. As long as you see a serial listed as confirmed, it should be accurate.

YEM1009 is one of those New 3DSes that came at the release date in February 13. Firmware 9.6 came in March, so i'm pretty sure this "Brand New" n3ds have been used atleast once and updated.
Probably not. Since you're buying it brand new and it says "In stock on November 1, 2015" then it's gonna be one with higher firmware.
Yes. It's gonna be really hard finding an n3ds on firmware 9.2 or below nowdays since amloast all the 3DSes sold at the release date are gone. You should look on ebay. I wish you good luck!
Instead of asking what or what not to get, you should ask yourself what you are gonna do if the firmware is > 9.2 after all these opinions from the forum.
and you were eager to listen to some people here that tell you to get it? Look for those that guarantee < 9.2 if you don't have a backup plan.
If <9.9, you have Hax 2.5 to use. Unless you are into CFW, <9.9 is quite good now Eshop is spoofed in HBL.
