My Aunt got scammed on Ebay

My Aunty bought me an 8GB USB for me for Christmas. I was experiencing a lot of problems with it like it corrupting every time i use it and very slow transfer speeds. I did a speed test with HD Tach and as you can see here the speed is quite slow at the start and fast at the end.
I thought this was very odd and at first thought it was because i had used around 2.3GB and using it slowed it down(pretty stupid thought). So i tried formatting it with SDFormatter 2.0 with overwrite on. I got the exact same results.
I then tried copying over 2.3GB to it as a test. I copied over 2.85GB of video and then tried to play them but none of them worked(in VLC, i didn't bother to test any other players). It then hit me that the partition table or whatever its called was probably hacked to say 8GB. How can people do this without feeling bad
It just makes me wanna do this to the guy that sold it to my Aunty
