For instance, during the day, the reflections on the shiny surface of the top screen distract my eyes and the 3D effect is lost.
Also, in games where there's lots of button mashing (e.g. Street Fighter), I tend to loose the sweet spot because of my movement.
I think the 3D effect would work the best for slowly-paced games: visual novels, point and click, logical (e.g. Picross), jRPG, turn-based etc. Not really for games where there are thousands of enemies attacking you at the same time, bullets flying etc.
PS. Did anyone really measured the power consumption with 3D on vs. off ? Normally, there should be no difference unless there's a need for doubling the backlight brightness due to the parallax barrier blocking half the light from passing through...
