Gaming Live bans - Console and/or gamertag?

My ancient ix 1.4 360 is on it's last legs, currently RROD fixed by me but sure it will die for good soon enough... So not worth a reflash, so at the mo, I'm patching newer games as I couldn't now care less if the console gets banned as it'll be in the bin fairly soon..

BUT

Might this potential ban also affect my gamertag? I always thought just the console got banned but I see peoples gamertags have been getting banned lately for playing games early?

yes, they are gamertag banning now, not just system banning

From my understanding the last batch were only Gamertag bans, not console. There's no real way to guarantee if they're sticking with that formula or not though from this point on.
