I read that one of the ways to get xbl banned is if you make a backup and play the game online before it's release date.

But what if there are games that are accidentally sold early before the release date? For example, Wal-Mart sells a 360 game early that has online play. What if that user went online with it? Would microsoft find that suspicious and ban them?

usually review copy's are caught which is what most of the early releases are

like gears 2 was leaked almost a month before the official release date and alot of people got banned for it

playing it a few days in advance shouldnt be a problem as long as its confirmed to be a retail release that some took from the store stock or something and leaked it online
