One more distinction - playing online might be possible with emunand. If the emulation is low level enough, maybe there is no way to build in detection (timing checks?).

Two issues:

- That part of the system would work "as a retail unit" (no modifications)
- Not sure, if installation can be done without decrypting at least the container. (Probably wrong use of that figurative concept.. ;) ) meaning, not sure, If we would have to "own" all prior firmwares, to be able to install the next one as emunand

Stuff like this will shake out over time.. :)

I think this will be much less of an issue. emuNAND will (eventually) be build below the kernel by rewriting the NAND reads to the sdcard. Now we will need to hide it on the sdcard from the OS, but that's possible :)

Second point does not truely matter. Even if the update can not be "just run", it will be possible to flash it in original signed package form to the NAND :)

I have no doubt that emuNAND/OFW will get ban free online play, eventually.

The nice part of owning the trustzone hypervisor :D

In any case - probability assessment is based on "will they allow pirated games onto their network" and "will they tolerate homebrew - if they can detect it". And the pessimist in me says "no" to both of those.. ;) The first one definitely not (Cheaters or not - thats just the excuse... ;) Once they have EA and Ubi at their doorsteps wanting to discuss percentages of the annual fee, they dont need extra motivation.. ;) ) , the second one - based on everything I believe to know about the company, and based on other "ideological changes" of japanese companies in that realm (Sony - The Linux Story.. ;)).

edit: Also: The "at least you get a mall percentage of a steady money flow" argument I believe was what Apple used to convince the music industry to sell songs for 1$ a piece.. ;) They havent forgiven them since.. ;) (Control over the ecosystem is always more important. "If you want to play online - you pay full price." Considering how much of the 20USD might end up at individual publishers, they could just as well allow piracy for "the promotional impact.." ;) )

Wasn't this the way the CFW works in the WiiU whenever we load it with the Homebrew channel/address exploit?
Could had sworn that's the way they did it, so that it didn't cause any timing conflicts on the system. If that's the case for the Switch, then it'll need to be refined, but could be extremely possible.

In the end, they could also"spare you" if you actaully have invested in both digital and physical for a while? That seems to have happened with a lot of 3DS CFW, but that's not saying that they're safe.

Well we never know if someone could also do something like on Xbox360 RGH\Jtag modded consoles... If you got banned you could buy online hours with the XboxLive emulator which they had a huge amount of unbanned X360 keys and even if your key was banned they would keep giving you fresh unbanned keys for the time you paid, but that was very expensive + Im not sure, but I think you still needed the XbL gold...

And I'm sure anyone who paid a lot just for a few hours of unbanned online would totally use their modded X360 exclusively to cheat online as much as they could and screw every other player.
