Title says it all. i am a little reluctant on ordering on in case of legal prosecution. Is it illegal to have one if i am making backups of games i already own?

Making backups of media is legal under the DMCA, the SX itself is a grey area, you won't get arrested for getting one.
Nope your good if you order one! I never got arrested for any modchip or flash card I ordered and the same go's for every other person in the usa. there is a chance that if your order is coming from china that customs can take it but that is really unlikely and almost never happens (only happened to one person i know of).

You are not going to be prosecuted for purchasing SX producs. There is nothing illegal about them, they only brake Nintendo's TOS.
If you own the game you make a backup of and the original copy (cart) becomes unplayable you are legally allowed to use it.

At worse you'd lose your package because they confiscate it at customs. They wouldn't come after you for that.
Yes as the device breaks the DMCA by circumventing copy protection.

tbh i think they're not sold in shops because since it breaks Nintendo's eula nintendo may refuse to supply the shops with their product. Meaning that the only place that you'd go look for videogames is a game shop, so if they also suddenly start selling r4s and stuff Nintendo may not want to supply them anymore and thus going out of business.
