Homebrew Is releasing a CIA of a game I made in Unity okay?

I made a game in Unity for N3DS (SDK) that I'd like to share, am I allowed to make a post here with a link to a download? I'm not sure if this is against the site's "Warez" rule.

You cannot publicly link to it here.

In this situation, I would probably make a thread for the project without linking to it, but tell others that if they can prove to me in a PM that they have agreed to the NDA, then I will privately link them to it.

Even if they have signed the NDA, you are not allowed to share anything with them unless they are registered as a part of your business/team in the admin panel.

Apparently third-party devs aren't allowed to release stuff for free on the eShop. :/

IIRC you do need to buy one of those test units to be eligible for eShop submission.

Absolutely not. You are contractually bound to only release games you make for Wii U and 3DS on the eShop or for physical release via a publisher.
