Hacking Is Nintendo still banning people?

Hi I have 3ds xl with gateway 3.0.1 on emunand 9.4.0-21 and sysnand 8.1.0 and when nintendo started to ban people i stoped going online but then i heard some people were able to connect online again and i was wondering what is the status on that now.

Just keep using private headers, that's the best advice we can really give right now, nobody knows for sure about the bans but Nintendo.

From what I've read it seems to be people playing Pokemon online with modified saves or playing online with Cheats enabled. If they are banned they are allowed back online after 2 weeks timeframe. As Jayro mentioned, just use private headers and no cheats and you should be ok.

that means the server is under maintenance, same here while playing monster hunter 4,
