Hacking Is it save for ban when i copy purchased dlc and softwares to another 3ds and dump cardridges?

Is it save when I have 2 3DS CFW installed systems and make .cia files from my cardridges and install it to both systems and copy my purchased softwares and dlc (streetpass Mii plaza games and swapnote premium) to another cfw 3ds?

When Nintendo see what I play, does Nintendo see if it is a cardridge or downloaded software?
