Gaming Is it safe to update 3ds to 11.10, use streetpass and update games?

I am wondering if updating the New 3ds XL to 11.10 is safe. With Luma CFW. Also if using streetpass (not Spotpass) is safe, and if updating pirated games through official means is also safe.

I am new to all this, so please excuse my ingorance.

From the link, "FW users can update safely. *hax payloads for older firmware versions are reported to be working on 11.10.0 for all regions except EUR." Streetpass is NFC, so that is always safe. N can not tell the difference between one console and another which means updating installed games will always work normally.

Getting banned on the 3DS only restricts online play. Other functionality, like buying games from the eShop and updating the console still work normally, and only things that can get you banned are playing games before the release date and cheating/using altered games while online.
