On another forum someone told me that you could play third-party games early and not get banned from LIVE. He played FFXIII and New Vegas (the game I want to play early) and he hasn't been banned. He is a reputable member. Can anyone vouch for this?

whoever told you that was a idiot if you play any game early or not verified you are always at risk of getting a ban to be on the safe side wait until fallout is verified on tuesday

Microsoft did ban people when some store released a game early, then a shitstorm was raised and they changed their policies.
So I'm assuming I'll be safe if I play New Vegas tomorrow?

When does the game come out? Playing it a few days early can be explained by a store not respecting the release date, but playing it a few weeks early is going to raise some red flags.
It comes out this Tuesday.

Microsoft only bans early copies if you play them illegally.

You have nothing to fear in the future.
