Yes, but:

1- you will be missing a system title, so the console will not count as fully updated

2- it's the use of the eShop or the in-app eShop ("mint") which causes licenses to be synced

3- you can solve the problem better by: removing your NNID (if you use one) then deleting your traditional eShop account, and installing wanted DLC before using again the apps mentioned in (2)

Thanks for clarifying.
I already knew about the three points you mentioned, but I wont update my 3DS unless it's an actual new update (I'll Google it 1st).
1. Well yeah. But it's not like I'll end up on frankenfirmware or whatever, right?
2. Hah, I always wondered what this "MINT" title was, thanks.
3. I know, but tbh I want to keep my NNID for now, incase I reinstall eshop in the future.

Another question, if I update it will simply restore it, right?
