it would've been sufficiant to tell em this isnt allowed every forum i visit has a different answer to if its illegal or just agains TOS of nintendo

NW4C, or any other dev tool for that matter, is subject to a software license and is copyrighted content. If Nintendo wanted people to use it, they would license it as freely redistributable - they have not. As such, we consider copies of it to be warez and prohibit requesting, uploading or otherwise sharing the DevMenu - you'll have to do some more Googling, you won't find it here.
