Hacking If I get Cubic ninja, can I be ban?

Yeah hum sorry for my english, my question is if I can download cubic ninja on my 3ds (with luma and all thing) without be console id ban?

I want to have it for a prevention (if I have to put again an other hax )
I want to test the game

but this game are used for hack 3ds, so can I have some problem if I download it ?

Not sure what you're trying to achieve with a Cubic Ninja rom, but remember that if you get locked out of CFW for whatever reason, you can't use a pirated game. So you won't be able to use Cubic Ninja to help yourself. A better option if you're looking for extra safety is to system transfer a bought compatible DSiWare game from a hacked console after having installed the hax save to it. Then if you find yourself locked out you can use it to restore a NAND backup.

So you won't be able to use Cubic Ninja to help yourself. yeah its not really clear what im want to make with cubic ninja, but its just for the safety and prevention like if I get some troubles with an ninja update or if im forced to format a part of my console if i get a brick and no good backup with me

a9lh boots even if you brick you dont need cubic ninja for anything

As above, also if you have any problems then it can't help you - if you have problems you won't be able to use it.

Not trying to be cynical or anything but if you are that worried about being banned from ANYTHING you do on a CFW 3DS maybe you shouldn't have hacked it? As @Crystal the Glaceon said the only things that will get you banned unintentionally is using public headers online, cheating online or playing an unreleased game online. You could be banned for hacked screenshots and stuff on Miiverse too IIRC. Point is, just having it hacked and using it normally (even if you install CIAs) will not get you banned period. Every day you ask if you'll be banned under a different scenario, the answer is no.
