what if nintendo gets really evil and goes something like this:
release update, update doesn't ban or do anything to hax users,
it is just a "coloring thing" it identifies which consoles are running hax and didn't buy 10 games minimum..
then, when loads of consoles are identified, BAM, secret backdoor worm starts running, it makes the console fry the nand or overclocks the cpu making the console ruined if was running hax

then release new updated hardware with current exploits fixed and nand memory is actually a ROM, meaning that you can't update or downgrade the system anymores

new exploits will of course be found with time, but all this diabolic plan was made before pokemon moon launch.
meaning, people will need to purchase new consoles for play the new best selling games.

Lol. But how are they going to check that people have bought games? Like I have a ton of legit games, but I hate having to drag them out in public because it takes five years to change the cart and I don't want to drop the cart onto the floor.

they know which digital games you legaly own... they just need to make a comparation between your tickets against their server, this is pretty easy to do..
(want to see something funny for yourself? go check the eshop settings and check the history, no pirated games show up there, only the purchased or the ones you had a code for.)

as for games in your sky3ds this becomes a little harder. but it's already implemented... remember when people get banned for using public headers?
they could put headers like game serials.. you couldn't use your private cubic ninja header to play pokemon x online...


seriously. nintendo doesn't care about piracy, unless you are a mass distributor of roms..

And I mostly buy physical copies of games. (Except for small games like Steamworld Dig, and Gunman Clive...)

They'd be in serious trouble if they tried to pull that shit. Partly because you can be guaranteed that it will also happen to legit users as well.
