patch your file using a nopatch dldi patcher after you dldi patch it. i have not tried it on non patched files, but in theory if the homebrew contains a dldi section this will write bytes to the nopatch flag. after that flash it to your kit and the autopatching firmware can't overwrite it.

then you must dldi patch the file first, then run it through the no patcher. i'm pretty sure you need to have the dldi file sitting in a directory of your card to have the auto patching work. so just leave the dldi file off the msd and the firmware will have nothing to auto patch with.

i have to ask why wouldn't you want the dualswan emu to be dldi patched for your card? are you fully understanding what dldi does? without the homebrew patched you will not be able to write any files to the mds directory of your m3. that means no save files (i'm assuming) or anything else.
