Your better just downloading on regular official firmware, then creating an emummc, which will have the nsp aswell aslong as you dont delete.
so I don't need to hack a switch with a clean sd card? I can just leave smash on the sd card when hacking it for the first time? some tutorials I saw said you had to format it and delete the data, others didn't, so I'm confused

If you intended to go online with your purchase and after modding on the same NAND then that is a no, you can't go online, formatting doesn't prevent a ban if you have pirated stuffs on that NAND.

Sure he has a clean NAND right now, but if he installed pirated game on the same NAND he attempt to redownload the game he would get ban.
Ok, but why the hypothetical. If he installed pirated games to a incognito'd Emunand and booted to ofw(stock) to play legit games online he will be perfectly fine.

To summarize, your gonna wanna format your sd card to create an emunand/emummc (emunand is a copy of your sysnand thats on your sd card)
As various people in have said, pirated content and cheats for emunand. Its always a risk to run cfw on Sysnand, BUT depending on what you do in sysnand will determine how likely you will be banned. Pirated content or cheating online is a higher chance of being banned compared to say save editing and emulation.

So if you really that worried, before you do anything, do a nand backup of you sysnand, copy that to your computer and various other places (this is considered a "clean nand backup") format your sd with hekate for emunand. Setup atmosphere to blank your prod info for emunand then your off to the races

If anything he needs to familiarize on how to properly hack his switch before even mentioning adding mods to a game.
You crawl before you learn how to walk, so the very first thing is knowing if his switch is even hackable considering hes new to this entirely which most ppl now own a Red Box switch or switch lite.

hahah thanks for worrying, but yes my switch is hackeable, I have checked the serial number and everything.

this makes a lot of sense, however, I can't redownload smash legally through the eshop on the emunand as I can't access the internet there, right?

Like some already mentioned, its really depends on what you are exactly intending to do, and how much ban safety you are ready to sacrifice.
If you want ban risk of 0, you need to use an emunand, which you keep fully offline, while alo not using autorcm. this way you will always be able to boot normaly to stock for online by just turning the switch on without a jig, while being able tp pirate, mod, cheat and emulate to your hearts desire on emunand. Whis way firmware updates will also not affect your abilty to boot the sysnand in any way,

If you want to use autrcm, to not need to use a jig every time, you can use hekate to boot into stock mode, by adding a stock entry with the option `stock=1`. Since hekate uses exosphere and the warmboot bin, this in theory is not 100% stock and you might need to update hekate and atmosphere after updates to be able to boot into stock. While this means there is custom code running in theory, there is currently no real way for nintendo to detect this, that wouldn't crash on stock, so using this with an offline emuand should have nearly the same ban safety.

If you want to do some streaming of online play of games, use the higher cpu and gpu clocks with bought games, or just be able to switch CFW/NAND/OS(e.g. android) without the need to reininject the payload, you can also use sysnand cfw. On Sysnand CFW you should not ever install any nsps, and be carefull with cheating and modding online, but its also relativelly safe (I'm using sysnand CFW only, since I don't pirate, and go online with it for years now, without a ban on any of my consoles). Atmosphere itself is also designed to be used this way, by disabling most of its telemetry, and atmospheres devs are going online in CFW themself. So while it might not be 100% safe, its still usable and allows normal eshop usage, firmware updates and online play the normal way. This liek the previews setup will need you to wait with updating the sysnand, until atmosphere/hekate support it, which normaly takes a few days, in rare cases more than a week.
This can also be combined with an emunand, to be able to play pirated games or do other unsave stuff offline.

In all these setups the emunand will be completelly offline, so its cant use to download eshop or systemupdates from nintendos servers, but you can dump smash from the sysnand if you are using sysnand CFW, and install it to the emunand. That way, it would remove the need to download any nsps.

Edit:
Another thing importent is, that even restoring a legit nand backup could result in a ban, if any logs got send to nintendos servers already, since the local logs and the logs on nintendos server will missmatch, so only use nand backups as last resort if you ever went online with the nand.

I suggest not having your legit games on emuNAND. The reason why is because as you said you can't connect to Nintendo servers on emuNAND anyway, and you'd actually need two copies if you want to have a game on both sysNAND and emuNAND, taking up twice the space so there is not much point. They'd also use different save files.

Absolutely use an emuNAND for CFW and keep your sysNAND clean for OFW as running pirated games on your sysNAND and then going online is a guaranteed ban. PRODINFO blanking (enabled by copying SD:\atmosphere\config_templates\exosphere.ini to SD:\atmosphere\config\exosphere.ini and changing the line blank_prodinfo_emummc=0 to a 1 so it reads blank_prodinfo_emummc=1) is highly recommended as it provides an extra layer of protection against accidentally connecting to Nintendo servers. Even though DNS blocking is also enabled by default an extra layer of protection is good as Nintendo can and do sometimes add new domains to connect to that might not be in the DNS blocklist. This allows you to go online in homebrew without connecting to Nintendo servers and getting banned.
You can use any guide that includes emuNAND and sig patches. If the guide doesn't include sig patches or if the sig patches are outdated (the links to latest sig patches change all the time) you'll have to add those yourself.

damn so, I have to get pirate smash to be able to play it on cfw? unfortunate, but if that is what it takes, then...

No need to pirate. When you create emunand, it copies the state of your emunand. So if you have the game reinstalled on sysnand, it'll be copied when creating an emunand.

Also I will state, if you're really worried about a ban and wanting your switch connected to the internet (not nintendo servers) have the incognito from atmosphere on, and use some form of 90dns blocker. Or just don't connect your emunand to your wifi

Not nessesary, like I mentioned in my post, you only need an emunand if you want to do unsafe stuff like pirating or installing nsps in general, or to be extremely safe(like 100% instead of I guess something like 99.9%). Otherwise you can just use sysnand cfw without emunand, or use sysnand cfw and emunand and dump it from your sysnand to install it to the emunand, to prevent the need to pirate it.
