    Hello GBATempers,

I have fell victim to the counterfeit microSD scam on eBay. I know the cards are fake because h2testw says so but I bet if I file a Paypal Claim (I've lost the ability to do claims through eBay) they won't take the h2testw log as valid proof. What are the steps I can take to get a refund? Can I provide proof to paypal of the fake cards on my own or do I need to get another party involved? I don't want to simply return the items back because then I'd be out on shipping (unless the seller wants to send me a prepaid label). I've bought 3 64gb microSD cards and all three are fake.

Post pictures of the original and the card you received side-by-side, compare serials, compare card analysis logs, that's about the extent of what you can do here.

Start a 'not as described' claim. You will win. You do not need proof.
But you have to pay to post it back.

Preform a H2testw with it and send it to Paypal.

Won't they still ask me to prove it if I say the reason is that it is counterfeit?

It isn't that easy is it? Theoretically I could make a "test" H2testw results file and send it to Paypal for an authentic card that I found to be counterfeit.

You have buyer protection on Paypal. They have to at least let you do a return.

    Videotape it?

Honestly, if a microSD is to cheap to be true then it's usually a counterfeit.
I pretty much avoid buying microSD's on Ebay just cause of that reason.

No. Say it is not as described. Post it back registered. And you will get your payment back.

Here's an update if anyone is interested: I had purchased a total of 4 counterfeit microSD cards (2 from 1 seller) On 3 of them I received automatic refunds as soon as the case was opened. I almost had to return one but I contacted Paypal and explained the legality of mailing counterfeit items in the US. They wanted me to use DHL since DHL allows mailing counterfeit items in the US (can someone confirm this?) but I received the refund. They didn't require me to destroy the item or anything like I've heard about but the cards will most likely end up in the garbage since they are bound to fail. Thank you everyone.

Yeah. One seller denied that the card was counterfeit. They said the card they are using is fine and asked me to send it back. You can't mail fake cards in the US so I just went straight to Paypal.

Since when? When you stick the card in an envelope does it immediately burst out screaming "NOOOOOOOOOOOOOOOPE!" ? They're small so it's not like it's even difficult to ship back. You could do it in a regular letter for a dollar.

Mail it back or live with it. Paypal can't do squat for you if you refuse to return the product.
Hell paypal wont do squat for you in any situation. They're extremely scam friendly and any illusion of security you have using paypal, you may want to cast that aside. The only security they give you is that your credit card information never passes into the hands of the seller. But if anything goes wrong, paypal would probably be the last and most desperate of steps to take to try and resolve something. In most cases they'll resolve in favour of the seller no matter what the seller actually says or does.

I see that your country is Canada. I'm not familiar with their laws but in the US mailing counterfeit items through the mail is definitely illegal (we call it mail fraud). I don't know since when but I do know it is now. You can't tell the card is counterfeit upon a glance but if you pay attention, you will see inconsistencies. And actually Paypal did do "squat". They refunded my money. I guess it's different in Canada but in the US, Paypal usually sides with the buyer.

Can you reword the question? I'm afraid I don't understand.

Yes, of course. (I forgot some words in that sentence ) "But what do you normally do instead of sending it back?"
I mostly had to send things back to the seller to receive a refund. But you don't seem to be allowed to send it back, so do you keep it and get a refund in such cases?

Best thing to do when facing the possibility of dealing with goods that run the risk of being fake is simply to say the item hasn't turned up (providing its not been sent registered post).

Do the mail police search your letters?
(that's a rhetorical question by the way, they don't)

You got extremely lucky that paypal did anything. It's likely the seller didn't respond at all. It's very, very rare that paypal sides with a buyer.

Odd, the 3 or so cases I've made against sellers I've always won and gotten a refund. Dunno your experience, but I've had nothing but good ones.
