I don't know where you read such malarkey but not only is that potentially illegal due to violating people's privacy but it is also not guaranteed evidence that someone is hacking.

In some days i will get my unpatched Switch. I will softmodd IT. . Is there a safe way to play still online without getting banned?

I mean if you only run homebrew on an emunand you should be fine
