I wonder how hig the risk of getting banned is with CFW
I have a new 2ds xl with software version 11.8
and I only play Cia games (without any cheats or other modifications)
my friends list settings are all deactivated (no other player can see me online or playing) and I have nothing on my "favorite software" selected.
in the spot pass settings is everything deactivated.
I play wery often super mario maker or super mario kart7 online

how high is the risk for me to get banned? (please in %)

Is it sill advisable to use those DNSes and hide current playing game?
The info is sent to Nintendo even if you hide the currently playing game, so if you want to be as safe as possible from bans, don't run CIA homebrew, VC injects etc. while online, and instead use .3dsx homebrew in Rosalina launched through the Download Play app if you need to launch homebrew while online, that way Nintendo doesn't see you running homebrew.
But they have pretty much given up on banning AFAIK, so you probably won't get banned.
