How did ebay start allowing flashcarts to be sold?

I like using ebay to grab a gaming bargain but over the past few months, some listings will be subtle and show that they're selling a flashcart by showing the R4 menu on the DS on the photo and a vague, "multi game cart".

Nowadays, just type in "R4" and it's like the heyday of DS piracy again with several pages of the carts for sale. Also flashed Xbox 360s and CFW PS3s are now a common occurance which is a very far cry from 10 years ago when a SNES I was bidding on that had the region chip disabled was removed quickly for "piracy".

As we see with the lack of updates to DS cart whitelist Nintendo is no longer focused on stopping them.
