Based of this youtuber Nick Robinson who I got to speak to via twitter. He didn't get a chance to look at the firmware but he told me that when he started his N3ds xl he was promoted to update it

There's no way Nintendo would manufacture any units with that 3-day lifespan firmware.
They would wait at least a couple of weeks for it to prove safe.

I believe the launch XL's will be <=9.2 for certain.

I hardly think the early sale of one New3DSXL isn't enough for someone to lose their manager position. They'd have to find someone to take the job, has good managerial experience, and has enough knowledge about games to adequately fill the job. It isn't worth it.

Besides, no one cares.

but since GW is region-free i don't know if it'll be worth the trouble
