Hardware (HELP)O3dsXL Top screen is brighter than the bottom screen

from the title does someone exprienced this?

Is it like that even after closing the lid and opening it again?

if I max the brightness the 3ds will crash and shut down

1) Turn on 3DS
2) Fold the top screen down (to go to sleep mode)
3) Fold it back up

Is the screen still too bright? Is the 3D effect working properly?

the 3d effect works just fine, getting to sleep mode and folding it back do nothing, still the same.
